My understanding of SKILL for US MS is that it will not be counted against the cap. I don't see it saying that PD does not matter for US MS. What am I missing? Thanks.

Good news and I am very happy for all Eb2...It seems like EB3 has not much hopes. It is moving at snail's pace, but with all the overflow from EB1 and ROWW going to EB2 only, looks like EB3 will take a long time to reach 2004/2005. If few of us in EB3 category get to see the GC before they leave the US, we should consider ourselves fortunate.

Here are the few main reasons for retrogression to India and China etc are
1) When H1B quota is 65, 000 the GC visa number is 140, 000 . But when they increased H1B from 65,000 to 195,000 the did not incresed GC visa numbers.
2) There is no country quota in H1B ( other than Chile and one more country for 7,000) visas. So most of the H1b's are issued to few countries like India,China and Philippines. But when we come to GC visa there is country quota.
3) We all know about that ilegal immigrants used some GC numbers which are meant for EB people.
We need to educate the USCIS why and how we are suffering in getting GC.
there is no need and use of blaming Desi companies. I do not support any illegal activities like sale of Labour certifications .
We all know about supply and demand theory which causes black marketing.
Selling of approved labour ( which has old PD ) is also same thing.

Let us all have a rally to move back to our countries on 4July2008 to symbolically show that we want our Freedom and Independence and never return back.
If all the articles about reverse brain drain we are reading about is true they would do something to solve this GC situation. Otherwise the anti-immigrants will come to see us off while we depart this country and never to return back as H1B's trying to get GC's and live here. This will go into history, 30yrs from now and our grandchildren will read about it. And may be we will get some special pension at our home countries for returning back and helping it to do better.

Do you have a copy of the H1B application?
It should show a lot of details about the employer and also as to who prepared the forms(attorney info if there is one)
As i said if the company itself has done the work themselves with a full time attorney...then the company is fully liable...if the company has hired outside attorney...the company is still liable...but the outside attorney would also be liable for building fake cases.
There is also a law that if the H1B employer has terminated your services before the estimated time your service was required then the employer has to pay you the transportation costs for your return home.

Today we might not be responsible for that, but I am sure lot of us will do the same after getting (if ever we get it) the Green Cards i.e. open such a consulting companies. Also we do not hesitate to call one of our friend, relative etc through one the tricks mentioned above. Finally many of us work or worked for such companies and let all these happen in these companies.
The sad part is that big companies like TCS, Wipro also do similar things, so why blame small desi companies.

The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.
There are far too many points here to address at one go. Let me touch upon this for starters:

Clause 4: To establish an uniform Rule of Naturalization
Are we disputing the fact that congress has the power to establish a uniform rule of naturalization?

Thank you for the reply. When you say that if I go with Company A that there will be more scrutiny, do you mean they will check the vailidity of the offer and their ability to pay? I work for a Govt. Agency(Company C), they will give me an EVL but I am not sure if they will specify "in accordance with I140". I am actually doing the same job, same place, before as a contractor(Company A) and now as an Employee(Company C).
This is what you could do. Take the updated EVL letter from your HR/ Supervisor. Attach latest paystubs as additional proof. Now for duties if the EVL does not contain this info then attach a copy of job posting advertisement that was issued when you were hired. Every govt job needs to be advertised. It can be in papers or their own website. Then get the lawyer to draft the AC21 letter and to point out the similarities between this job and your labor.

There is Buy Rate and a Sell Rate. The Buy rate is about 50-60 Cents less than the Sell rate. You get the buy rate when you send money...
I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.
It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.
How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.
What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.
Any help/suggestion/comment?

I will be affected since I came to this country through body shop and this affects my I-485.
I think there is a lack of direction as to what we people on H1 can do. We need to unite and fight otherwise we must be ready to go back. I am not ready to go back.
