My company got an RFE for ability to pay from USCIS. we are responding back with my companies 2006 tax returns and w-2 which shows more than proffered wage determined by Dept of Labor during PERM. I hope this should be fine and I will get a favorable response.
My concern is whether I should apply for 485 or should I wait till 140 approval to apply for 485.

Imagine if Uncle Sam held an auction to allow you to submit I485 EAD AP, what would you have bid for the right to submit?
Maybe $640, $6,400, or even $64,000?
If Uncle Sam charged a fee to submit now rather than waiting for another year or two or three... What would you have paid to submit I485 and get EAD AP AC21?
Alternatively, how much are you going to benefit from EAD AP or AC21?
AC21 -- maybe ability to move jobs and get a few thousand $ pay rise?
AC21 -- maybe not going to the back of the queue -- really worth thousands!
EAD for you and spouse -- maybe a week of salary for someone that could not previously work?
AP -- how much is it worth not to have to waste time and money renewing H1B at an embassy. That's at least a few days of time you don't have to waste (and time is money).
How much will you save from filing under the old fee structure? At least a few hundreds.
Now use that as a guideline for what you are going to contribute to IV.

Many of us are waiting to file I485. Think about them who have filed and are stuck in namecheck for 2 years plus or waiting for visa numbers to get current- they are renewing their EAD every few months (and guess what, they are paying extra money).
Now that the atmosphere looks good for businesses (via increased H1Bs), people who either voted red or did not vote at all, are getting scared of possible democratic party actions.

All that appears on this website is discussions about EAD, AP, buying a house etc. etc...These are very informative and useful.
But, what about our larger goals? Will we ever get out of this rut? When will the retrogression end?

Dont even think about it unless you are a quant and have resources that can compete with the Hedge funds. Commodities do not behave like stocks, you need to be able to model prices using multi variate models. Then there is jumps. You should be familiar with jump diffusion/step functions etc. To be able to model these you will need to use a factor model like the Pilipovic model. Even then it will only be an approximation.
Commodities are purchased as futures. Futures are derivatives and you will need to hedge them. A perfect hedge for a future is 1:1 in the spot. Since there is no arb here you will have to use options. To model the price of an option you will have to be a master of Black-Scholes option pricing model or a similar method like monte carlo simulation. Even if you figure all this out you will have to delta hedge. Delta hedging commodity options is very expensive, you will bleed money. Look up Hodges-Nuberger model for delta hedging options on derivatives.

i'm not sure i understand. but maybe i'm not good enough for "reverse brain drain" and to those who voted "yes", please confirm July 4 that you are leaving. i saw some of you tracking receipts in desperation? why, why for god's sake? if you are ready and willing to leave in 6-8 months did you care so much? wish there was a way to hold each one of you to your words.
and anyway, what are you doing for that "freedom and independence"? how many of you are actively helping in iv's lobbying effort? just sitting around and watching or criticizing is hardly winning any "respect". please don't make me point out individuals and start pasting their previous posts here...

I am a LEGAL immigrant how has waited in the line for Green Card for 10 years. I've paid my taxes, social security, medicare and followed the law. Immigration bureaucracy and inefficiency at USCIS has meant more than 250K of Green Cards within legal limits have gone waste leading to a very long wait for legal immigrants.
Please tell me what I should do - Wait another 10 years? Go back to home country? or jump the fence?

2008- LEVEL II : 4000
2007 - LEVEL II : 11495
2006- LEVEL II : 14616
2005- LEVEL II : 841
If you add-up these figures it comes to Total EB2 PERM:: 30,952. Now remove 2008 ( 4k) and some people ( 5k) uto 2006 got their GC's by last year. So that figure does come to very close to what Senator letter is saying.

Well, I don't think gctest is against EB3. He is against consultants from sleazy bodyshopping companies, which is right.
A career based on lies and deception is criminal in my humble opinion. There are people who actually came to US with valid experience and education, but still end up applying in EB-3 because the employer did not oblige. Sad for them, but it again boils down to the fact that if the job description qualified them for EB-2, then they got cheated. Otherwise, it is just.
I would like to clear the stand that I am a MS holder from an American university and I work as a Sr. Engineer in one of the top internet firms. I left an offer from that crappy operating system maker because that job did not require MS or even BS+5. It was BS+3. I chose a job where I get to apply in EB2.
People who crib about not getting a chance, even though their job description did not support it are wrong, IMO. NO ONE forced you in to that job. This is not slavery and US is not the only place where you can get a job.

I am glad IV is focusing more attention on the name check nightmare. I filed 485 in December 2006 (EB1) and am stuck in the namecheck.

bringing bk the discussion to more serious point. We can all agree that on the surface immigration system here is seems unfair towards Indian, Chinese and Mexicans. Whats the reason behind it? why only three countries which suffers from long waits. Its demand and supply. If there were no country caps, all the visa's will be absorbed by these three countries. Even though it has cost me time and money, i think its the right policy. for a moment imagine there was no country limit, can you imagine for few years to come immigration will be from only these three countries. i think its only fair to limit how many people can come from one specific country.
and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it :)

Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.
In my view your words "Get a life" certainly applies to the following set of people (in that particular order):
Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.
Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.
Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.

2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

Isn't H1B renewal more risky than I-485 as for H1B you have to worry about more things like, Prevailing Wages, LCA, Ability to Pay and even from the cost point of view for H1B most likely you will need a lawyer whereas for EAD/AP it is doable on your own?

Received one today.
Weirdest thing:
Person's 140 was revoked by employer;
person received notice of intent to deny. NOID clearly stated that 140 was revoked by employer then quoted ac21 law and said beneficiary may be eligible and to give job offer letter.
person responded with letter from new ac21 employer with perfectly matching job duties/descriptions.
uscis sent denial. Denial only stated that 140 was revoked and 140 immigrant petition is needed to get greencard.
Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.

Thanks guys for all the posts. I guess I have a little ignorant question. If I am married does my wife need to be here for me to file her 485. I am getting court marriage done in July 2007, and hope to file my 485 as soon as I have my marriage certificate, I am sure will be filing in July, but my wife won't be coming to the US till Jan 2008, which is when we have will have the ritualistic wedding. Does she need to be here for any paperwork. She could come on H4, but her parents won't let her stay for long. Does she need medical tests as well from civil surgeon when I file for her? I am hoping she can come in Jan on H4, and then get her EAD along with mine.
