    This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.

    A question -- has IV considered challenging the country quota in court? Because the Constitution forbids discrimination based on country of origin..

    I'm just keen to find out what's going on, and to get input on whether the I-129 being revoked is anything that can affect the I-140/I-485. I doubt it but would like to be sure. And to share what's going on in my case with others where it may have more of an impact if their H-1B ends up being revoked.

    Anyway, I doubt if it's anything that can't be fixed; my company is very reputable and our attorneys are already engaged.

    You had mentioned in your previous post that your EB2 green card was approved in June 2007or did you mean EAD?
    Am I missing something?

    Again, including her name on your I-485 application would not help her to "get into the queue". You need to file another I-485 for her and you can only do that if she is physically present in the US. (you need the I-94 card). You could have the court marriage in July and bring her here on an H4 or other visa, and then file for her I-485 as well.

    I am in a similar boat as you, except my ritualistic wedding would be in Aug and I am banking on the hope that the dates would still remain current for August.

    Thanks manojp4, appreciate your help. Just to clarify my doubt, she would need to file a 485 anyhow, before the dates retrogress again, right. Would it matter if I included her name in my filing, along with the marriage certificate. I guess all I am trying to understand is I know 100% that I will be married before I file, would that help her in anyway, lets say if the dates retrogress in August and she cannot file till then.

    I know you are a committed member and you contribute as well. You have been helping the holiday thread to be on the top too. I was talking about my IV holiday fund raising to one of my co-worker who is a US citizen and who does not have an Indian/ Asian ethnic background and he had mentioned to me you guys are 25,000 people and all of you are hard working legal immigrants. you dont need to go to anyone else for money. your group is financially very strong. If all of you put in 10$ each month you will have 250K funds available every month. What you should really work on is get every member to commit to that 10$ every month. What can we do to get every one of us put in that 10$ every month?

    I have read my post couple of times before posting to avoid any mis-communication...but it's never possible to prevent I believe:)

    I have a recurring contributions setup and also contributed what ever I could this holidays...probably will contribute more before the end of the season. My post is not about the Monthly contributions made by you, me or many others...who signed up.

    It's about the ones' who cannot for what ever the reason may be....you and me pointing to the salaries or house-hold incomes will not help them join the wagon.

    It's about increasing the donations irrespective of people joining the monthly-contributions scheme....Other viable options...may be having a IV donation boxes...in immigrant owned businesses....etc.

    In an ideal world as you mentioned atleast 20000 of 25000 will contribute monthly....It's defintely good to aim for that....but that's not realistic.

    Both DOS and USCIS do believe the recap bill is going to improve their efficiency. They had made it very clear in the Immigration subcommittee hearing on "wasted visas" held on Apr 30.

    They might got feed back from DOS and USCIS also.

    I hope DOS and USCIS give positive feedback to recapture visas.

    K , I see two views by two different types of folks.

    View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

    View #2: Some people come resigned with the idea that they will be looked down. Now My question is what do you want to accomplish on IV if you do not want to work on the issue, If you do not want believe in the core principles of this organization. If you think that immigrants are treated like dirt and again if you believe in that and because you are an immigrant in this country, you should have been putting up with a treatment like dirt, do you have an iota of self esteem?? Seriously, If you really believe what you are saying why do you even want to be here now? or why do you even want to have a backup plan that will again make you a immigrant some where else?? $$$ over ride self esteem Huh? In the name of discussion you want to shape the opinion of people who do not talk much. Kudos to your agenda. You keep spitting out your rhetoric that immigrants are dirt but cannot make arguments that hold water for a single second.

    I compared the president to show that immigrants and sons of immigrants can have a life that is quite opposite of what the OP said. Just because you or some one you know treated some one bad does not mean that every one treats others the same. Did some one say that you have to get a life because you chose not to do so? Yes, there are many other countries that have smoother immigration process. Every one is welcome to explore them and you did. In fact, IV wiki has sections dedicated for immigration to other countries. You can chose to develop them or can chose other wise. Just because you have explored other options and found some thing that suits your situation does not mean every plain jane can and will find one. You expect the US congress to get its act right, modify the immigration system and have all of us walk on a red carpet. That would be ideal. Even I will love that. As that is not the case and some of us has chosen to work with the US Congress, you consider us folks who dont have a life. It comes down to the difference that you dont want to work on this issue and have things served on a silver platter, while many of us want to work and fix this issue. Rant as much as you can but all of your arguments contradict each other

    Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. Coupled with the lack of GC, his risk might be more than some one else.

    Dude, You might be a new entry in to the ball of Immigration now. As said earlier , every one is free to judge and post the queries. If IV is shutting door of any questions you wouldnt have seen forum threads. There is enough discussion and direction taken on information being released to ALL members. Why one should complain IV not doing anything ?

    here are some atleast, immaterial you agree or not:

    1. If ppl are reaping benefits of EAD for multiple years , its becoz of IV.
    2. whole of July fiasco was a win becoz of IV , not sure whether you are in the boat, but i can see the pain and how IV helped all of us.
    3. all the admin fixes were co-ordinated by IV ,
    4. The list goes on.. those 3 above are just enough to prove the help an ORGANIZATION did with minimal resources. Also please note none of the core are full time IV , they are also ppl like you and me.

    Reason one has donor forum is becoz they are trusted sources. How can one know that you are pro-immigrant or anti-immigrant.

    You would see dialy or minutes updates on sites of anti-immigrants becoz they have dedicated members and number base is too high.

    Again , no one is shutting door against you, looking at your post i see you are shutting door against yourself just becoz your idea of Fax through AILA is not acceptable as an IV agenda.

    Do you know first of all what provisions in CIR 2007 were in there which would have broke the back of ppl on H1 and potential immigrants? Can you confirm which provisions of CIR 2009 if there be one will help you ? will you support CIR even if it says you have to go back to india in no time ? AILA never mentioned in first place whether it would support EB community.

    Plain simple, we pay Dollars even to newspaper ... You dont want to contribute for your own cause but get info for free and prove that will raise for your own cause. Those newsletters are for your benefit and collectively for the whole community.

    Still IV is posting info to non-paying members , IV Never shuts its door but with limited resources they are doing what they can. Before complaining on IV you do your part. :cool:

    Also , FYI... AILA doesnt post all messages to free members .. all the critical info is circulated via PAID members of AILA.. this is part of any organization ... Can you complain against AILA, becoz if you are FREE member of AILA you still get emails like the one reg. Fax to CIR... There is a lot going in background for CIR than many of us even know...

    Raji - I don't know how long you have been around since you just started posting. If you want to promote Family Based Immigration go ahead and go for it.

    We all at IV are for EB visa recapture and would want to use our energy and resources for that. IV has done a lot of things for us in the past and continues to do so. In fact IV is the ONLY organization that fights for us.

    The last CIR was like a bill from hell for us Legals. You can be very sure the coming CIR is going to be like this too ( with the job enviroment so bad ) . Unless we see something concrete helping the EB community in any bill , supporting it doesn't make any sense.

    I don't want the transfer of EB unused visas to FB visa category. As such they already have much more visas every year .

    If any employer is minting too much and troubling a lot, make all necessary advances that one can physically produce, in such case once the person is approved with good status of Green Card one can sue the employer, that would be the right time to bring him to justice.

    Looks like you are one of the beneficiaries of H1 who does not have good education. You can console yourself with the word 'skill' and all that computer jargon The bottomline is H1B visa is for professionals. However, in the past few years, Indian IT bodyshops have sent underskilled computer operators to the US to enhance their operating margins. This will come to end very soon and has to come to an end very soon. I think the process has already begun. Number of H1b visas rejected at Indian bodyshops have gone up. Operating margins at Infosys has shrunk significantly. Infosys and other bodyshops have seen stock price plummet drastically.

    Companies such as Congizant have stopped bringing people from India on H1. Rather they are trying to hire people in the US who already have H1B visas. The illegals who have gotton their H1B from shady consultants in NJ, CA and elsewhere. Congizant is doing community service by legalizing illegals. The people who sat on the bench during recession while holding their H1B visas without a paycheck. Sorry with paycheck which needs to be refunded to the employer by personal check. Stop the fraud, please stop the fraud.

    Again you have provided no arguments to support why you believe IGNOU or Univ or Phoenix are fraudulent. Just because you believe they are...does not automatically make them so. Please provide proper reasoning.

    Instead you jumped to a different topic of IT bodyshops which is unrelated to the two people who asked if they qualify for EB2

    Was your previous approval based on an extension ? [Pending LC/Approved I-140 etc] ?
    Does your current transfer require documents from the previous employer ? [LC/Approved I-140] ?
    Were you paid the prevailing wages mentioned in the LCA of previous H1B ? Can this be supported by the W2 of last financial year [Not the paycheck].
    Did you have I-94 attached in the previously approved H1B ?

    Please answer these questions it might be helpful in finding what might have raised the red flag.

    I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.

    Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?

    I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose.

    *sigh* I might have just opened myself up to the ones that like to attack....go ahead...

    Friends,

    I did a quick search and did not find answer to this. Apologise if this is a repost.

    But a co-worker of mine wants to travel on AP. After coming back, he will join my company (right now he is a contractor) as a perm employee on H1. Is it possible and allowed? Can he transfer H1 after using AP?

    Our company attorney confirmed that his H1B will remain valid even after using AP. But she is not sure about transfer. I will post her reply once she gets back to him. But in meantime, if anyone has any idea about this, please share.


    Thats correct. Once you use AP, you loose H1 status and your status is "Adjustment of Status".

    As far as joining a state chapter, you don't need to have face to face meetings at all. We haven't had even ONE meeting in NORCAL in the last few months.

    Several state chapter members have collected & mailed to us dozens of letters without meeting us even once.
    When there is time to act, you don't have to worry about how far you live etc.

    The joint efforts of SoCal & NorCal are an excellent example as well. Gsc999 from NorCal has been to SoCal once in a while to help them with a Diwali Mela or a Letters drive, and SoCal folks drove to San Jose for the rally in July 07, and drona from SoCal helped us organize a Diwali mela event in NorCal in 11/2007.

    More recently, rinsuper from SoCal called up hundreds of IV members all over California, then mailed us a bunch of 50 letters she had personally collected!

    If there is a will, there is a way. If you insist on having a local chapter, feel free to setup yourself. IV will be too happy to help you do it!

    Just a quick clarification. The time line extension for Admin fix letter campaigned was requested by various state chapter volunteers including myself, abhijit and others. The reason was the traction they were gaining after volunteering on the ground for few weeks. The idea was to leverage that instead of just ending the admin fix letter campaign on a fixed date.

    Abhijit: yes, thanks to you and other highly motivated volunteers in California and other states we have been very successful in highlighting our issues to the necessary "powers that be." This is an ongoing effort and not an ad-hoc strategy. We will disclose further steps when necessary.If people want the low-down they need to be involved and go the grass root volunteer work

    Fellow IVers hang-on in there. As someone said,"It is darkest before the dawn." The old members go and new members come in that is to be expected.

    Let keep our focus on our mission

    not sure how to do this. can some one in this thread create a poll just for eb3-India just to see a ball park number of people waiting in eb3 india and for how long they are waiting (may be we can start from jan 2001 all the way till jun 2008). This atleast would give us an idea of how many IVers are waiting in eb3 queue..pls discard if you did not like this idea. thanks.

    Called NSC on 9/3 and IO initiated an inquiry. Not sure if this is equivalent to SR. With in few hours I got a reply email stating the exact following message. It says awaiting review by an officer, but then the last line says "Service is waiting for VISA availability". It's too confusing and it sucks.

Furthermore, if all initial evidence was not included with you application, or a question arose during adjudication that required a Request for Evidence, additional time would be needed. Your application remains awaiting review by an Officer and you will be notified as soon as a decision is made. The Service is waiting for VISA availability.
