My wife has a H1 since oct 2006 till date she hasn't worked and hence has no pay stubs. her passport has a F2 visa. I want to convert her visa to H4. Her employer is asking for 6k to generate 3 paystubs for 3 months. I dont want to pay so much. if we go to canada to get H4 stamping will they ask for her pay stubs or just my pay stubs are enough.
Is there any chance of rejection. also can I go to canada for stamping or do i have to go to home country.

There were many I-485 applictions from EB2 ROW from 2005/2006/2007/2008 pending (some stuck in namecheck, some just filled in rack and some waiting an IO). All these applications where getting approved in 2009. Recent trend 2008/2009 I-485 EB2 ROW apps are getting approved (meaning not many old apps left).
Going forward EB2 India/China should see forward movement (and if i can esitimate right big numbers for year 2010 if recession continues).
It could be true that those ROW app will be around 22k so no cut off dates adn there will be very less spill this year. So really slowdown in economy helped them a lot. Next year if economy continue to be slow then it may help india lot. but not 100% it will clear backlog.
We need recapture to clear all backlog.

Disclosure : I have already received 2 year EAD (thanks to IV). I have taken initiative to bootstrap the effort to help others who haven't been so fortunate. Since we are all in the same boat let us watch each others back for a change, instead of trying to backstab each other at every available opportunity.
This is NOT a yet another case tracker /EAD tracker thread. I don't believe that just tracking stuff will change anything. Be it EAD issue or any other, real world action is needed to solve it.
I have started this thread to guage the impact this issue has had on our community , how many members are affected, what actions have been taken by them, so that next steps can be taken. If a large number of members are impacted IV may decide to take up the issue.
Here are the options available to applicants
1) Call National Customer Service Center and create a Service Request (SR) to expedite the case
2) Fax and mail a letter to Service Center requesting to expedite the case due to possibility of job loss. Since the burden of proof is on the applicant - a letter from the company that EAD is necessary for continuation of job may help.
3) If steps 1 and 2 don't produce the results and CRs refuse to open SRs citing silly reasons, USCIS Ombudsman may be approached.

4) Approach your US Congressmen/women Representative/Senators. Every office has a different form for requesting Immigration help. They can open an inquiry with USCIS on your behalf.

We shouldn't feel embarassed at the question "Did you follow up with all these avenues available to you?". Our answer should be - "Yes. We did all that and it didn't help". And we should be able to produce the proof that we did do all the four steps mentioned above.
If you have done all the four or after you have exhausted all avenues, AND are willing to take it further - speak to the media, participate in possible IV campaign etc., post your details. We need members ready to go public with the issue if we want to succeed.
Right now, I have started this as an individual initiative. But I am sure that IV will get involved once it's proven that a large number are impacted and there are enough members to turn it into a campaign.

My PD is April 2002 which has become current as per the june bulletin. My I-140 was approved in April 2007 and the NVC created the case on May 15th 2007.
I have opted for consular proceesing.
My questions is at what stage of the further processing do i get a visa number allocated ?
Is it when NVC sends the fee receipt to my attorney or is it when the case is transferred to the consulate ?
I just want to know at what stage now i become insulated from any possible retrogression in the coming months.
Any help much appreciated

DA knows that for them to win the case, they need your wife's statement on their side. And for you to win the case your wife will have to testify under oath. The attorneys are prepared on both sides to argue this case and examine and cross examine the case. Make sure you have a really really good attorney.

Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.
Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).
Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.
Interesting experiment, and I can see that is how human beings respond sometimes.
However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.
Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).
Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!

A much fairer, simpler and permanent solution is to simply rollover the unused numbers to next years numbers.

issued per year, and that is what IV wants to change. As Dr. Philip Martin
from UCDavis wrote, "There Is Nothing More Permanent Than Temporary Foreign

When I started reading the Washington Post article below the first question
that came to my mind was the legality of H-1Bs and other foreign nationals

very serious about lobbying the U.S. government. They hired a professional
lobbying firm to represent them called Quinn Gillespie & Associates LLC. IV
also is talking with the infamous lobbyist Rick Swartz. Norman Matloff
described Swartz as a "pro-immigration lobbying kingpin who has represented
both industry firms such as Microsoft and also the ISN". Mark Krikorian at
CIS is usually low key, but not when he wrote about Rick Swartz:

And then there's the National Immigration Forum, the umbrella
organization for high-immigration political advocacy, which
works closely with sympathetic Republicans. But NIF is not like
the conventional lobbying coalitions that exist on numerous
issues. It was cofounded by the National Lawyers Guild in the
1980s, back when the Guild was a Soviet front group. The group's
first head was Rick Swartz, a leftist attorney who cut his teeth
advocating for Haitian illegal aliens and who, during a 1981
Senate hearing, likened the United States to Nazi Germany.
Most of the Immigration Voice activities seem to center around fund raising
to pay for their lobbying efforts. They aren't talking about chump change

When I started reading the Washington Post article below the first question
that came to my mind was the legality of H-1Bs and other foreign nationals
to actively lobby our government. The DOJ answers that very definitively:

The article below is written by Mitra Kalita. She was born in the U.S. by

Kalita does a good job of reporting what Immigration Voice is all about but
the article is not objective, and therefore should be considered lousy
journalism. It's a rather long article with quotes from many advocates for
increasing immigration but not one sentence from somebody that disagrees
with the IV agenda. This statement about IV's quest for more green cards
for H-1B visa holders goes totally unchallenged:
"This is a sympathetic story," said Nick Maduros, a lobbyist
for Quinn Gillespie. "For this group, their issues are very
technical and are frankly not that controversial, but they
have been overshadowed ."

Immigration Voice raises many questions but one stands up in my mind as the
most important:
WHY AFTER 16 YEARS OF H-1B HAVE AMERICAN WORKERS FAILED TO ORGANIZE
THEMSELVES TO FIGHT FOR THEIR JOBS?
There have been many attempts at forming organizations but all of them are
struggling. In all their years of existence they haven't been able to raise
even a fraction of the money IV has raised in just four months. ZaZona.com
as well as many others are operating on such small shoestring budgets we
are continually struggling just to survive.
Why do citizens of the United States lack the passion we are seeing from
foreign nationals that are here both legally and illegally?
One thing for sure, we shouldn't waste time griping about Immigration Voice
because they are playing the political game according to our own rules. If
we lose this one, who's fault is it?

I filed My concurrent I-140 and I-485 in Schedule A Group-II , EB-2, Exceptional Ability in Arts and Sciences Application with USCIS recipt date of AUGUST 24, 2006 for both I-140 and I-485?
(1) My I-140 is yet not approved I had asked my attorney to do premium processing. In this new situation should I go for premium processing or hold it back as they will not process my I-485 due to un availability of numbers in Schedule A.
(2)With current retrogession in Schedule A in November visa bulletin What will happen to my I-140 and I-485 processing.
(3)If Schedule A categorey ends after 10/5/2005 as indicated in November visa bulletin what will happen to CASES like mine which were filed after that? does they get transfered to EB-2 ( or EB-3) with their filing dates, set as priority date?
(4) Does establishment of date of 10/5/2005 in NOVEMBER visa bulletin means that they will still process application that they accepted till this NOVEMBER-2006 .
