Siva tells me that the flowers are indeed being delivered to the USCIS office. It has created quite a stir.
Of course, we do need to keep the entire campaign in perspective. It is not something that Brian Williams is going to open his evening news with. In fact, he might not cover it at all. After all, when you compare it with the immigration rallies of last year - this is miniscule.
But we did generate quite a bit of media attention with this, we did prove that the skilled, legal immigrant community can take collective action and we did prove that the decisions made by US lawmakers and the beaureaucracies end up hurting real people behind the numbers.
I think all that was worth my 30 dollars.

Let us assume that EB2 is going to be current in a year or even sooner than that. Given that situation, and arguing that about 500 people jumped ahead into line over you in to EB2 from EB3, still I do not foresee that their GC's will be approved before the people who are already in line, because
1) as FIFO is not being followed by USCIS, probably they are processing cases based on RD,
2) PD porting is effectively done at the time the second I-140 IS APPROVED. At I-485 stage you can only hope to PD recapture and cross your fingers after sending a no fee letter. This will surely would need additional scrutiny, hence is not a so called 'Low hanging fruit'. Even if an EB3 person wants to start his process right now, it will not be probably before a year and half to two years before he/she is ready to port, and by that time you are past the gate or significantly nearer.
so my point of view is if you look at this thing negatively, you would have a Heartburn and related health issues, but if you are positive and an optimist you would deserve what you get.

I support your view. Let this punjabi guy go into foreclosure and screw up his credit history and suffer for the next 7 to 14 years. Its not just him, his entire family will suffer because of this.
Those who oppose the foreclosure, i think you guys are indirectly helping this punjabi guy. He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. If he is not going into foreclosure then how do you think this guy will suffer for the next 7 to 14 years?

My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.
Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

After eight months, my rebate was rejected without any reason. When I wanted to cancel my connection, I had to wait more than two hours in line and had to call more than couple of times. But still vonage charged my CC for cancellation fee. I had to file a dispute with CC. Thats the reason I never want to use their service and never recommend to anyone.

Call (in the morning) 1-800-375-5283 and follow this sequence: 1,2,2,6,1,1,1,3,4.
If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.
thank you for your info on calling uscis and requesting namecheck info.... i called them today, asked about FP 1 and if it had been sent out... they told me to wait for FP notice but they were able to check for name check info..... name check has passed..... 485 RD July 16 2007... thanks again for uscis contact info

Don't know if anyone noticed but Mr. Emilio's statement nowhere indicates any acknowledgement of the hardships caused by the fiasco. If he (and USCIS) knows about "flowers", I am sure USCIS knows about the scramble, hardships and frustration caused by the fiasco. A simple acknowledgement through something like " ....while we regret unintended consequences of following our internal procedures, we have made arrangements to forward the flowers to ..." would have demonstrated leadership or honesty of intent which I guess is in short supply
I think he is trying to say if anybody needs flowers its our men in uniform and not us (USCIS). I hope I am wrong but thats my perspective. Have sent the flowers anyway ;)

Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

I agree totally, this is a catch 22 situation for employment based immigration and agree that this will only divide more of us who are in different situations and are all waiting in line. I am not on L1 but to have introduce a bill that is protective in nature will only hurt immigration even more in the long run. Some of us may think this will eliminate lot more people from the line so that we who are working as permanent employees can get our green cards faster. Consulting companies are not just small companies, KPMG, Microsoft, Delliote, Oracle all of they offer some form of consulting to their clients. How will this law be implemented, what will happen to us who plan to change jobs after getting green cards and plan to consult if these companies don't exist. Every time a bill gets introduced, there is an intent but there is also the question of how it gets applied.
I think this will only hurt us as written from reading everything, this has all the language on discrimination against otherwise eligible workers, remember someday all of us who are permanent employees may be working as consultants, if you think today this is applied only to H1/L1, what will stop them from applying against EAD holders too? After all how many of us are on EAD, 300K? do you think that is a big enough group.
Stay together, stand together and read between the lines. Always fight for open legal immigration for employment, if you feel somebody is not qualified, so be it, its for the employer to make that call if he or she is qualified or not. Does the letter need to have the same information as the LC. I can get a non I-485 related employment verification letter but here is the catch. The employer is dilly dallying on filing for I-485. The employer can give a letter with my job title which is "XYZ Developer" include salary, length of employment etc. But the "Final Determination" copy that I have says occupation: Computer Software Engineers, 15-1031. Does the letter have to state "Computer Software Engineer" or can it state "XYZ Developer" ? If it has to be the former that will only alert them that I am bypassing their stonewalling and the employer is only likely to refuse to include that as the job title. So which is which ? The job specific title ie "XYZ Developer" or the DOL title per the "Final Determination"

EB3 has a significant drop, Most of ROw applicants are filing in EB2 these days thus offsetting any significant advantage in filing EB2. EB3 will be faster comapred to EB2 some time between 2014-2015, EB3 still gets 40000 of quota.

Finally, 5882 is our only hope for now.

So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.

Sec 503 of Marc Spector's Immigration reform bill gives 25% of all EB visas and unused visas to un-skilled workers.
This shall hit all EB category visas hard and might cause more retrogression
