There are two things in play here.. first of all don't worry about the insurance since you can get covered under Cobra.
Secondly I think what your employer did was obviously illegal. It looks like you have been made a target for layoff due to your maternity leave coming up. I am quite sure that I have read about this at couple of places that it is unlawful to do so . I will try searching for it and you also go through your company's employee booklet. There are laws for protection in this kind of situation to protect the employee ( the employee can't be terminated while on maternity leave , disability leave etc ). Search for it and maybe you can come up with something.
You have worked hard for six years .. no reason to stand for the discrimination.

Maybe you should request to send an e-mail on place. This is what we did.
Send email to who ? Can you pls describe in detail what email they need to send and what reason they need to put in. My local office always says NSC is processing July cases so you should have it soon, but that "soon" has never happened. It is 160+ days since I applied.

I am very happy for India.
1.Now most of the work that is being done here by H-1B professionals will be done in India.
2.Innovations will be made in India. As more money is available for the companies to pump in to R&D
3.Indian IT infrastructure will improve.
I am not so happy for USA.

I apologize as this is not completely relevant to this thread....
Can someone confirm that there is no filing fees for EAD and AP renewal for people with I-485 receipt dates after July 30, 2007? That what's the instructions says, and I called up USCIS and they confirmed it. I just wanted to see if anyone on IV received EAD and AP without fees?
Up until last year I was using a lawyer and they always made me pay fees for these application, so was wondering.
I will appreciate your response.

I am surprised...why IV is not raising this.. The fundamental issues of EB immigration wont' be solved until CIR happens and that could take forever. No one cares about immigration right now.. The only thing that can provide immediate relief for EB immigrants is if we express our desire to buy houses(unable to do so becoz of lack of GC).

Far as I am concerned, unless you hae situation of life and death, you must not steal. The only other scenario, where theft could be pardoned is if you are out of work, have no money, have no friends who would help you, have been turned out by the local soup kitchen and the food bank, and have starving children at home and you decide to pich a loaf of brad from a store

Hello Gurus,
I too have changed employer (B) from july 1st and have not yet filed AC21.
I have contacted attorney (who filed my GC and I-485) and he said he needs an authorization email from my old employer (A) to proceed further. I have asked my "A" for the authorization email and he is acting like he is not getting my emails. He is not answering my phone calls, even by mistake if he answers my call he is saying he will call me back, but never called me. i dont know whether he will revoke the I-140 which was approved in around April 2007.
I don't know what exactly I need to do in this situation like to wait for old employers' call. He was very nice when I was his employee, but from the moment I left the company, he is a changed man.
What are my best choices in this situation?
BTW, I have paid all the legal expenses for H1s and GC processing.

You are not required to "file AC21" when you change employer. Please don't worry about anything here and let USCIS send you an RFE if they want about change of employer. and let your employer revoke your approved I-140 if he wants to. It will not affect you at all provided you've cpmpleted 180 days after filing your I-485.
If the attorney is a company attorney, I suggest you file a new G-28 to either remove the attorney and take the case in your own hands, or hire another attorney who has nothign to do with your old company.
You are good to go and you don't need to do anything about AC21. It's not a document that you have to file, It's a law that you can use to change employer after 180 days of I485 filing with an approved I-140.

Just talked to my lawyer..he said even if we win the case...eligibility is based on the court order...court order may allow every one or only limited people who are in the class action...and in murthy.com they clearly mentioned that, USCIS MAY look at the apllications very closely who are in the class action....who wants that..

I think you should go to either Eatentown( Exit 105 on GSP). Before they started accepting all immigrant applications at all DMVs they used to ask every one to go there. I think you may be able to get a temporary extension for month or two.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

it depends on the individual hospital... your downside is only your wife getting fired... which might not really happen unless your wife supplies 100 A grade nurses to the directly competing hospital across the street... if she does that, anyway she wont care for the job.... :-) all the best... let us know how it goes...

The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.
For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. Since the EW cut-off date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002.
B. DIVERSITY IMMIGRANT (DV) CATEGORY
Section 203(c) of the Immigration and Nationality Act provides a maximum of up to 55,000 immigrant visas each fiscal year to permit immigration opportunities for persons from countries other than the principal sources of current immigration to the United States. The Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997 stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually-allocated diversity visas will be made available for use under the NACARA program. This reduction has resulted in the DV-2011 annual limit being reduced to 50,000. DV visas are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.
For April, immigrant numbers in the DV category are available to qualified DV-2011 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers BELOW the specified allocation cut-off number:

Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery. The year of entitlement for all applicants registered for the DV-2011 program ends as of September 30, 2011. DV visas may not be issued to DV-2011 applicants after that date. Similarly, spouses and children accompanying or following to join DV-2011 principals are only entitled to derivative DV status until September 30, 2011. DV visa availability through the very end of FY-2011 cannot be taken for granted. Numbers could be exhausted prior to September 30.

D. RETROGRESSION OF FAMILY PREFERENCE CUT-OFF DATES
Continued heavy applicant demand for numbers in the Family First (F1) preference category has required the retrogression of the Worldwide, China-mainland born, and India cut-off date for the month of April.
Further retrogressions cannot be ruled out should demand continue at the current levels for some categories and countries.
Not much good news for EB2 and EB3 India. I hope folks realize and do the lobby day seriously.

I'd say, we've waited enough(6-12 years). I know we are all chasing the american dream (perhaps it is just a dream), we should just make peace and move back. Thank you congress, america for giving ppl (from so called 3rd world nations) like us the chance to come and serve this great nation.

Really a revolutionary idea. I like the idea of redrawing middle east map. It is over due now.
While talking about rederawing of boundarie, there is another interesting proposal doing the rounds in the global political discourses. This one is not a prediction, but a proposal to redraw the boundaries of the middle east. The idea was initially proposed by someone called Ralph Peters in the Armed Forces Journal in an article titled "Blood Borders" .
The core idea behind the proposal is that the state boundaries of middle east are unnatural, and it has given rise to artificial, nonviable and oppressive states. The only way to permanently solve the problems of islamic terrorism is to redraw the boundaries of the entire region.
The idea has been floating around on the Internet for a couple of years now. No wonder, the nationalities set to benefit from this proposal (Baluchis, Pakhtuns, Kurds, Shia Arabs etc) are enthusiastically rooting for it, while the ruling elites of the so called artificial states like Pakistan and Sunni Iraqis are adamantly against it. Nevertheless, it is an interesting read.
