Its simple. If your priority date is <Year> then you wish it to be in <Year> and you predict to be so and say that the rest of the categories will not move.

Hi All,
I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.
Can some one please let me know how i can handle the period that i was in bench in 2008.

If you entered US on a valid Visa through a POE after June 2008, you are covered. You need to prove your legal status only since your last entry to US (Entering using AP does not count). If your employer didn't pay on bench, that is your employer's problem.

True - that's exactly what the Adjudicating Officer told me today when I went in for the Interview :)......They want to avoid another July 2007.
So, for efficiency, they are just pre-adjudicating some of the applications; so that, they don't get overwhelmed when dates move forward - they simply have to press the button for 'Card production ordered' message!
In fact, the officer told me that he has 'approved' my application and will have to just wait for the dates to become current to get the actual plastic - also for fyi.....they can also deny the application instantly or request more evidence or call for a follow up interview. They actually give you a letter indicating what happened during the interview (it obviously doesn't say your application is approved - but it will explicitly say whether your application needs a follow up interview or additional evidence).
Although officially so far, USCIS has not branded an I-485 status as "pre-adjudicated", if you haven't received any RFE and/or any other negative status about your 485, and if your case is outside the processing dates of the Service Center, then obviously dude your case is pre-adjudicated.
I tend to believe that the offical status of being "pre-adjudicated" is coming soon. A few months back I read that USCIS is considering publishing another set of date known as "Qualifying Date" in their monthly visa bulletin. That date will define if you are "qualified" to file I-485. They will determine this date based on their workload. The idea behind is to avoid another July 2007 fiasco. They intend to process the 485's early rather than have you wait for your PD to become current. That way they will manage their workload efficiently and avoid visa wastage. The party was mostly good. I only regret that sometimes, I could not hear what people on the other side of the table were talking about. The room was too dark and not quiet enough. It might have been better if we had a round table.

Are they not supposed to make sure that they have enough senators on their side to pass this bill. Whatever we have won till this point is due to the efforts of core team and people who come to this website using media/campaigns. I have not seen results of any lobbying efforts by this lobbying firm. Am I wrong somewhere ?

I filed for my I-485, EAD and AP on July 2nd at the Nebraska Service Center. I am EB2 with a PD of June, 04. I haven't received any receipt notices. Any one in the same boat/ who has been through this process would like to share their views? Also, given the current fiasco, by when should I expect finger printing notice and, realistically, the green card?

The turnout could easily have been higher (like someone said, see the lines to the doctors office for getting medicals done when the dates were current, and compare that with how many showed up at the rally).

I don't think that the rules are unfair. If both parents are Indian citizens, then the child is eligible for primary citizenship of India. Hence how can he be allowed to take OCI when he infact can get primary citizenship? Also the rules are created with rules for all countries in mind not just USA and also they are intended to protect those who lived in India, paid taxes in India and these rules are to protect interests of children born in India.
I live in US with my wife, we dont have any kids and yes I am in race for GC. But I also know a few couples who applied for US passport for their kids, went back to India, got their kids educated at Indian Citizen's fee schedule in general quota and then sent their kids to US back with citizenship of US.
Unless in some exceptional cases, I don't think US kids can education in India at regular fee schedule. How do you prove your kid is an Indian Citizen, to consider your kind under regular fee schedule?
