    Off topic, but I'm confused in figuring out the standards for closing topics in this forum. I've seen threads with much lower tone, fewer personal attacks and cleaner language being called useless bickering and closed.
    I don't mean anyone personally, and I can be wrong, but to me it seems like if the people involved are not moderators and expressing reasonable argument against an IV goal or IV practice it's quickly a target for closing. While if a moderator is involved and has enough supporters to overpower the other party, the thread is kept open with no problem even though it's the same level of bickering and insult exchange.

    how goes life with you? its human to see things through personal lenses. when you are involved in a thread and want a discussion you (or i) will always feel it is a target, if it gets clsoed....
    personally i hate closing threads. i give tons of warnings and keep stating...i will close...but rarely do :-)
    in this case, the effort is to bring the thread back to the original discussion, in deference to the original posters.

    we seem to succeed intermittently....until we are thrown back OT :-)

    hope it's a sunny warm MN weekend!

    ps at the same time moderators are human too...and i don't think there has been much overpowering here, last i noted, i was the one apologising :-)

    I salute IV and team involved in all this process right from organizing the rally at San Jose last saturday till resolving this issue. I am sure you are going to get lots of good wishes from all of the people affected by this July bulletin fiasco.

    Hats off to all who were involved in resolving this and also for participating in the San Jose rally and flower campaign.

    GREAT JOB IV. You have made a day to remember for all the affected applicants.

    I can't wait till we see the results of this initiative. Having a source (website, tool, whatever) that tells me how many people are in line ahead of me, and is refreshed on a periodic (monthly as new bulletins come out) basis will take a lot of the guesswork and day dreaming out of this.

    A lot of us are in this mess for the long haul. A clear picture, even if it doesn't make the dates move any faster will ease a lot of anxiety and frustration. Atleast for me, it will.

    If you're sitting on your ass thinking that there are other people contributing and their contributions alone will help meet the goal, you are wrong, most people are thinking the same way.

    The way I see it, if you don't contribute/act to solve problems that you face in life, you have no right to whine about them.

    Be like me, contribute, and then whine all you want.

    (translation: sit there like a paraplegic in the line and do nothing ... while a massive line jumping is in process... you will keep seeing while all these EB3 "bodyshopped consultants" will continue to slowly port their PDs and get approved ahead of you.. EB2 I/C is in for a really really long wait.
    Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!

    We need to let uscis know and audit all current and past approved cases from these consultants)

    FYI ...With support from a few people .. we are in the process of filing a Direct injunction for stoppage and immediate audit of interfiled/approved cases. But more support would be appreciated.

    1. What led to this interview? Did they schedule the interview or you took an infopass appointment?

    2. When IO reviewed your case, did they look at your physical I-485 file? Did the service center transfer your case to the USCIS office you went for the interview?

    Yes.,.they had all my forms and xerox copies with them..transferred from TSC to NBC to Field office

    This was the first time I participated in the event - I had no idea of what to expect and what can be achieved. I can honestly say that meeting all the people who attended the advocacy days showed me the dedication this group has and also realized that there was so much more to initiating laws and passing laws and how futile our arguments are on the forums regarding different categories in EB.

    In the meetings that I attended either the staff knew little about our problems (green card backlogs and legal immigration) or they knew of our problems and told us about the vast hurdles in the political environment that keeps popping up and derailing immigration reform. However, at no time the issue of EB1, EB2, or EB3 ever came up!! At the end of Monday, most of us met to share our experiences and as far as I can remember none of them mentioned it either. There was a lot of discussion on what the staffers wanted to know about IV and the solutions it was proposing. We were met with both understanding as well as skepticism - and I believe our job is to have more discussion with them and to make them see our point of view.

    Obviously we cannot be in DC to do this all the time, but I believe that we need to continue to keep in touch with these staffers as well as make repeated visits to the local district offices too. Two observations, many of the staffers wanted to know if we were from the district or the state that their offices represented - and even though IV tried to match this, we just lacked members from certain area, so fellow IVians, I request larger and wider participation in such efforts. Secondly, I have met with both my Rep as well as one of my Senators office locally, and when I mentioned it to the staffer in DC, she was very happy and was more receptive.

    I want to take this opportunity to Thank IV for opening my eyes to a world that I live in but never cared to understand. The road ahead for us immigrants is hard and long, but now I have started to pave the road with IV leadership. The question is will it be just few working hard and long? Or can we hope for better with 40,000 members?

    I came to the US in 1998 for a Masters program. After graduating in 1999 December, I took up a job with XXX,in yyy city in Jan 2000.
    XXX applied for a labor cert in July 2001 under EB3 category traditional processing and I am still waiting...there has been no movement in my application at all and it is April 2006 now.

    In Fall 2003, I joined an executive MBA program at University of XXX, YYY city (ranked # zz globally) and completed the program in May 2005. I have not been able to take up any job that I can use any of my two graduate degrees and my MBA is pretty much going waste right now because I can't change jobs. The job description for an MBA job isn't the same as an IT specialist for which my labor cert was filed back in 2001. I got a Marketing Manager position job within XXX in Jan 2006. But I was unable to transfer because of the same reason. I have been told not to search anymore for management jobs because there is no point in getting them unless I get my greencard.

    Nice work, ItIsNotFunny.

    This is also an example of what this community is capable of doing, when we have a clear goal and proper directions on how to reach that goal. In just 3 days, we could raise $5000.

    I have one message from Pappu that they have some updates on this. I don't know any details so far. Hopefully we will get some account information soon! If not, we will see how to create a pool account for this and then submit to IV. One thing is for sure, I don't think we can not afford loosing this golden opportunity. I don't want to loose this to bureaucracy.

    Thanks everyone for support. So far pledge is $4300. We are close!

    I moved to the US on a H1 visa, from India 7 years ago. I have a Bachelors in Engineering and a Management degree as well. I work in the areas of Business Intelligence and Data Warehousing. An area of expertise that helps corporations here in the US become competitive and stay competitive. Among other benefits, my work aids businesses in making informed operational, tactical and strategic decisions and gain competitive advantage.

    With this retrogression, It is going be several years before USCIS will even get to my file to adjudicate. While I understand a green card is not my right, I think I have worked towards it for a long time now. I am in this country legally, paying taxes, contributing to this economy, spending my earnings in this country like any other law abiding American citizen.

    I have legally asked this country and USCIS for Permanent Residency (PR). My request for PR is not based on the premise that my parents/relatives live here and are citizens in this country. I am not even asking for Permanent Residency because of the country I come from. I am asking for Permanent Residency based entirely on my educational qualifications, professional expertise and the demonstrated contributions I have made to businesses and the American way of Life.

    I have also been accepted as an Instructor at a reputed University in California where I will be teaching in my area of expertise. This clearly helps the American society and Industry.

    When I moved to the US, I believed America is all about meritocracy. Work hard, prove your worth and you get what you truly deserve. I feel six years is enough time to prove your worth to get a Permanent Residency.
    My tax returns, my legal Status documents, my contributions to this economy etc will prove it. What is really disconcerting is the fact that, now I have to continue to wait for I don't know how many more years for USCIS to even look at my credentials, let alone give me an up or down decision. Mind you this wait is not because of any delays attributable to me.
    Is this fair ?

    If you think you don't need me, at least tell me, in a reasonable period of time. Please do not make me wait indefinitely.

    I dont know if i agree that ND will dictate approval. On there are several approvals with RD and ND in 2008. What explains that?

    Since we are not there we can't know the whole process, but it is true that there is always some logic when it appears to be random. We just don't know that. And that logic is not always fair, as is the case in visa distributions.

    Published processing dates can mean anything between two extremes (i) Everything filed before published date has been processed, (ii) Nothing after the published date has been processed. Most likely it is close to (i). Thus, if published processing date is Aug 30 '07, it does not mean that they have not looked at any case filed after this date. I believe cases are distributed in lots, not one at a time. And if someone takes his/her lot of 1000 cases for processing, and then goes on vacation for 30 days - the lot just waits at his/her desk. Therefore, even if published date is Aug 30'07, it is quite probable that Sept/Oct'07 cases, even later cases, may have been seen. Also, note that published dates are as of June 30, not current.

    We don't know the whole story,but are trying to find some logic in what goes on. So, positive view is that if you will be Current in Sept hope for the best.

    We have 1485$ holiday contributions so far and one 50$ contribution on this thread. We need more.

    Here is something to read for you:

    IV in 5/2006:

    About 4000 members, 2800 of which had not contributed anything, and even then IV managed to pull off this amazing feat.
    This amendment was PASSED although the CIR bill failed to survive.
    In other words, if there had been a bill only to address EB GC reforms, there was a great chance YOU would be able to file for your I-485 even if your PD was not current!

    IV in 11/2007:
    1) IV has 25000+ members.
    2) The EB GC reforms proposed and passed as an amendment in mid-2006 are long overdue!
    3) IV has gathered a lot of admiration and attention after the flower campaign/ SJ Rally-> leading to the July VB reversal, and of course the DC rally!

    Even if 2500 of them pay $50 a month, IV would have a steady flow of $125000 a month for lobbying efforts.

    Just imagine what IV could accomplish in the next few months, if only people realized how important it is for them to sign up for monthly contributions!

    If it is true, they have revised the process, and that is good. Hoever, it also depends on how the question was posed. If you asked whether processing is based on RD or ND, they will defnitely tell it is RD. One need to ask, which of two dates will determine case processing status, if your stamped RD is 3 months earlier than the receive date you see online. Note that the site tells you to contact them if your "receipt notice date" is prior to the published date, and you are still waiting. What is "receipt notice date"?

    I did cearly tell her - both my RD and ND and asked her which one. She said there were some delays during that time to send a notice date hence the gap and it doesnt count.

    I had to be persistent with my complaint with the Ombudsman. Finally I got it later in the year. When I sent my complaint in, sometime in July 08, I thought I was among the few who were left out. But this thread suggests that there are a lot who were bypassed when they gave GC's to PD's in 2005 and 2006 last year.

    So you got GC when your PD wasnt current?
