Are you kidding me?
What does your lawyer say about it?
Does your lawyer know that your wife supports you?
If the person you committed the Violence on, is not ready to accept it, how are they even offering you battery?
If you did beat her, were there any witnesses? And do not respond to this question in positive.
There is definitely something missing here. You are either not saying the complete truth, OR your wife is not supporting you, OR you are suspecting that she will testify against you.
DA offered:
Keep on DV battery charge, no jail time, 52 weeks anger control class, 3 yr probation.

I talked to USCIS information center at (202) 272-8269. They asked me to submit Form G-639 (it is available at www.uscis.gov --> under forms section). It has all the instructions to request the copies we needed.
The following is the direct link for the form g-639:

Lately i see a lot of new members coming up in the forum, with lots of questions about their problems that they are facing. And lots of good hearted IV members also give their diligent answers for them. One hand I am glad IV is getting new members, on the other hand i am wondering where were these members all these days.
Please don't get me wrong, As much as I like new members joining in the forum to get answers for their questions, I also would expect them to take part in any the activities or initiatives that IV is undertaking. Therefore I urge, every new member to volunteer in the IV activities and be an active member of IV and be a participating member, so that IV helps you and you help IV. Having said that, new members, WELCOME TO IV, post your questions and I am sure you will get good answers from many good hearts in IV.

The November Visa Bulletin will almost certainly look exactly like the October Visa Bulletin. The Visa Office has already warned not to expect any movement until the CIS gets around to figuring out how many cases they have and the priority dates of those cases.

Hi desi3933,
My wife got approval notice from 10/01/2006. Her employer is willing to give paystubs from March 2007. Will this put her back in status so that she can file I-485?
We are planning to resign after she file I-485 at July end and apply for COS with 2 paystubs. Will this cause a problem or is it legal?
Could you please advice?
Thanks
I read from a different post that you can file for AOS if you are out of status for less than 180 days. there is a section 245(k) which allows you to do this. I don't know the accuracy of this info.
this is from murthy.com site
Section 245(k) enables a person who is adjusting status in an employment-based category (whether on the basis of a labor certification or in one of the special Green Card categories that does not require a labor certification or job offer) to adjust, even if s/he has been out of status or worked without authorization for less than 180 days. This provision does not require an immigrant petition or labor certification to have been filed on or before any particular date and there is also no penalty fee involved.

They are talking about Both H1b and Green card. Corporations are pushing for increase in H1b also. But this time they are giving some importance to green card also. That is a good development. Already Skil bill by Cornyn is there. May be in next few weeks it may come for voting with or without attachment. But approximately 4 to 5 votes will decide the fate of the bill as usual in the Senate. And also as usual anti immigrants may push Durbin Grassley bill. We will wait and see.
are we sure that they are not talking only about H1b?
Does following mean they are looking at Green Card as well ?
"attract and retain high-skilled workers to contribute and excel in the U.S. economy without unnecessary delays and waiting periods?

I got your point and that of logiclife's and I agree....there is no need for them to mention it.
The writer could as easily have said "also" or "on an unrelated matter" or many other ways to dissociate "high-skilled" from "illegal", yet he purposefully chose to link the two with the word "but"

Once it is I40 is appoved it will go to national visa processing .. .Once the pd is current NVC will send a mail to you to pay the fees. Once they receive the fees they will send all the documents to consulate . Usually i think it is 45 days to 3 months depending upon your luck. After that consulate will call you for interview.

I know I am not going to get my GC righ away by attending rallies/meetings and activity's. But there should be an efforts from every one to raise their hand and contribute for the cause. Appreciate the core members and state chapter leaders for your vision and work.
At the same note,I regret for not being at DC after meeting some of the members yesterday.
Before, I have little/no idea of how to approach lawmakers (my idea of meeting lawmakers was like meeting politicians in INDIA, Zindhabad...Zindhabad type), glad i do now !
Main concern/talk was about not many people turning up with 3000 IV members in the tristate, I strongly believe we can do much better in the number department for the next meeting. Again, not just numbers but with some motivation to take part in the events to come.
I did not like the leaders thanking the members just because they turned up! It should always the other way around, members should thank the leaders for organizing such events. After all it is for ones own benefit, no one is doing a favour to any one!
Come on folks, join ur state chapters.
Good to hear from you sweet23guyin... seems you guys had a ball after I left.. ;-)

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.
While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year over a 44 percent increase in the number of cases pending more than 33 months. (page 37)
The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year. If a new immigration bill is enacted, millions of undocumented immigrants would also apply for legalization. (Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))
Currently, USCIS has limited capability to produce reports detailing the status of long-pending FBI name check cases. In addition, USCIS systems do not automatically indicate when a delayed name check is complete and the case can be adjudicated. Often, this leads to a situation where the validity of other checks expire before USCIS reviews the case. Those other checks then need to be reinitiated, adding financial and time costs for applicants and USCIS. The Ombudsman fully supports the expeditious rollout of the BCS system. (page 43)
the bureau since 2001 has intensified the scrutiny of immigrants with high-technology backgrounds. (Washington Post (http://immigrationvoice.org/forum/showpost.php?p=85213&postcount=365))

r u IV Policeman? Can I see your badge?
Dear snehaledu, You raise a good point. Am I IV policeman? The answer is NO. Guess, it is the responsibility of all the members to police themselves. And I saw that it was not happening here, thus my question about the relevance of this thread.
I understood that IV is working on behalf of green card backlog applicants and the intended purpose of IV forums is to provide support for legislative effort. Please help me understand how this thread about $1 is Rs. 44 or whether $1 is Rs. 46, helping in achieving IV goals? I am just scratching my head in an attempt to figure that out. There are many other forums on the internet where you could discuss anything under the sun. There are many other forums where you could discuss everything about exchange rate variations. Why dont you go and discuss it over in those forums?
Also, we all should be considerate towards all other members of IV. It was my understanding that IV membership includes people from all over the world. It may be true that majority of IV members are from India. Should we as Indians show a bit of maturity and consideration towards members from other countries? Is that too much to ask? Say, if you come to these forums and for 2-3 days consecutively you see a discussion about conversion rate of Pakistani Rs. to $, how would you feel about it as that discussion will not be relevant for you? Intelligent people understand the signs and fools dont understand even if someone shouts in front of them. I guess there is no country in the world where its entire population is either all fools or all intelligent. The real question is which category do you belong? You dont have to answer that question; your behavior will speak for you.

Hillary just cares about vote bank. The Bay area group that invited her should not endorse her.
Shame on Dems.
The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)
see the info here about bill: http://www.immigration-law.com/Canada.html
Yesterday, Senator Cornyn introduced on the Senate floor Amendment 2339 to H.R. 2669, FY 2008 Budget, proposing the following temporaary relieffor the employment-based immigrants. Sadly, the bill was rejected by 55 Nays, 40 Yeas, and one No Vote. Do your want to know who voted against this bill? Click here.

We are proud of the Senators from Minnesota, Norm Coleman (R) and Amy Klochubar, by setting aside the partisan politics and casting bi-parisan support for this bill. THANK YOU, and THANK!!

Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc, west virginia north and south carolina. Arranging busses for the students is not a bad idea. Students once convinced why they need change in current immigration reforms for employment base legal immigrants will participate in huge numbers to attend the advocacy efforts done by immigrationvoice.org as they have more time in hand
