1. Ball park figure is total of 218,000 visa wasted from previous years. How much of it will go to EBs (and others) will be based on how the recapture gets implemented. If we don't do anything and sit quiet, it may as well be ZERO. Nurses will walk away with the cake

Why would they think like that?, USCIS made a mistake. They tried to cover (by making visas unavailable) their ass to save their jobs. Thats why we have congress to help us out.

Call (in the morning) 1-800-375-5283 and follow this sequence: 1,2,2,6,1,1,1,3,4.
If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.
I called today and they couldnt tell me anything at the 800 number they just said that they would contact me if they needed any information.... guess I just sit tight for now!

I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.
There is no number to call here to check on status - I have been sending emails to mumbaiNIV@state.gov but have not received any response from them yet. Not really a surprise. If anyone tries the number above and gets some response please let the rest of us know.

There is nothing wrong in fighting. At least it will be used to prevent the same mistake in future. But it is not a bad idea to analyse the outcome so that everyone can prepare for that. My view is this campaign will be used for preventing future mistakes. I will be pleasantly surprised if we get more benefit than that. Even lawsuit also will serve the purpose and will give strong warning to USCIS.
I can tell many examples. Due to one persons misjudgment so many American and Iraq people were killed. Do you think they can get relief? Whatever relief people got it cannot bring back peoples lives. But still lot of people are thinking that Iraq could have been handled differently and many people are fighting against War. Most people realize mistakes after someone is impacted.
In the name of thinking differently we have smitha, senthil1 , asdqwe..and these guys confusing this struggle / fight for us trying to get ahead of the line or as senthil1 keeps saying uscis/dos made an honest mistake and asdqwe..keeps saying we need to fight for legislation rather than wasting time with these efforts. What all these guys and their ilk fail to understand is most of us are pissed off about the way it was implemented and handled rather than the ability to file AOS itself. If we sit and do nothing is like asking uscis / dos to walk all over us again and again. Besides in US law whenever there is a gray area, the decisions are based on precedents. same here Buddy, i was told that cases assigned to officer on Aug 3 and pre-adjudicated.(NSC)
havnt heard back eversince. got standard reply to SR:
"Your I-485 case as August 12, 2010 is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter."
I am in the same situation. I share your pain.
I think the scientific community should stop their search for a black hole. Considering the difficulty in extracting the least bit of information from the USCIS, they will beat any black hole hands down. :-)

It's tough to tell. According to processing times on usics.gov, I-90 takes 3.5 months in Nebraska service center. But the form is supposed to be mailed to Phoenix and I could not find any times for the Phoenix office. Since it's a simple correction, I'm hoping a 2-3 week turnaround time but be prepared for a 3+ month wait. If you need to travel, it's better to get an I-551 stamp in your passport so you can travel regardless.

Does one need to be physically present in US in order to file I-485 application? I had already booked my travel to India on May 25th before I came to know that the my Priority Dates had become current. Will I need to be in US till I get the filing receipt? I was curious on how would UCSIS know that I'm out of country on the day of filing?

Below are the list that I have from my lawyer to prepare my I-485 :
1. for Evidence of status you need a Copy of Last Entry I-94
non immigrant arrival/departure record, showing your admission
to the US and current status. (Front and back, make sure the date is
clear to see)
2. To show that you are always in status while you are in US you will need
Copies of all immigration related documents from USCIS
(such as I-20, OPT, H1B, H4 approval notice, or other status)
3. Copy of Birth Certificate
(need translate & notarize if not in English)
4. Copy of Marriage Certificate if you are married
(need translate & notarize if not in English)
5. Copy of Passport pages with non immigrant visa
(including all passports you have used since the last entry you need to
copy all the stamp you had on the passport. Again this is to show the
last time your in you US and to make sure you are always in status)
6. I-693 (Medical Exam)
(You can dial 1-800-375-5283 to choose the physician list)
you will required to show a proof that you have take MMR, Varicella, Tetanus and hepatitis B
if you can't show any proof they will required you to take it on their office and it will cause you quite a lot money ( you can take
the vaccine earlier on your family/ regular dr. office and could get covered by you insurance) it could save you $300 per person.
the mandatory test you have to take at their office is tb test, blood test
for HIV and syphilis and regular phisical test. once you have all vaccine
and the mandatory test they should gave you the seal envelope to send to USCIS along with your other document and they will give you a copy as well.
7. If you apply for your family member you will need
I-134 (Affidavit of Support) stamp by Notary for each family member
8. Employment Verification Letter
Employement letter on the letter head of the petitioning employer
which confirms that the job on which visa petition is based is still
available to you. The letter must also state the salary that will be paid.

My husband's petition is from a reputed company, and its an L1 blanket petition... the petition approval date is somewhere in Nov. 2007... does this mean that it would take a long/short time to update in PIMS?

We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.
I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.
Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.
I think this bill will not be passed if it is against WTO trade regulations.

I asked this question several times on all the threads that are discussing the new USCIS data, but no one seems to be answering this, but I think it is important to make sure this wrinkle is sorted out...
When they say inventory of 485 apps.. by any chance does it mean only the 485 that has been pre-adjudicated? I wish that was not the case.. but these numbers are too small to believe otherwise.. I hope one of the doctors in USCIS VB Theory (and I know there are a whole lot of them here on this forum) can sort this doubt quickly by throwing some nice logic.. But I would like to hear that so I am convinced with the quality of thi spread sheet.

It makes sense to file concurrently only when PD is current. Otherwise it is like applying for your citizenship before getting your GC!
In other words I do not understand why your lawyer wants you to file concurrently when your PD is not current. Just to collect his fees? Maybe. He is at least right aboout the fact that USCIS will do nothing with your I485 application unless your PD is current. So I would just wait till your PD is current. You can still file for your I140 and wait for that to get processed.

Since January 2006, the nation's Capital has been fairly quite on immigration news for a number of reasons. Firstly, the comprehensive immigration reform legislative bills were planned to be tabled in February 2006, but reportedly this has been pushed off until March 27, 2006. Secondly, the New Director of Citizenship and Immigration Services took office last months. Additionally, the career immigration benefits leader, William Yates, retired and new acting director took over the immigration benefits management responsibility. Understandably, when the heads of the organization change, pending review of the policies and directions, the organization's activities on policy making usually remain on halt.
As opposed to the immigration benefits issues, there have been flurry of news coming out of all sources throughout the country relating to the immigration enfocement and border security initiatives. There are sporatic and increasing reports that ICE has swifted the enforcement policy from leniency to reinforcement over the illegal aliens despite its inability to keep up with expanding detenion facilities to house the detained illegal aliens. The ICE has just announced that it will cease the practice of arrest and return of the border crossers and enforce detention of such border crossers. There were reports that ICE officials stopped certain traffics in certain locations in Minnesota to demand legal documents and enforced illegal immigration action against the detected illegal aliens.
