I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.

Yup, you got it buddy......my point is more from a general perspective than any individual scenarios........and sledge_hammer.....I am well aware of the risk associated with every investment - I do own a house and am paying monthly mortgage installments even when knowing that my investment is at least 100k under water :)......so I perfectly understand the risk that comes with any investment AND i am not blaming my lender for giving me money - as I said before, I could afford it then and I can afford it now!
I am against this 'nobody saw it coming' and 'too big to fail' business - banks very well knew what was coming and what would it's effect be; they still went ahead and irresponsibly gave out money to people who can't even afford an eat out at Mcdonalds!!!! Nobody should give any bail out to these guys - let them suffer for what they have done; if I am acting responsibly for my deeds (paying monthly installment because I signed up for it) the same should apply to these banks - they should be allowed to fail simply on the fact that they didn't make good business decisions!

If the post is true and from real world person, then the OP and his sponsor are in violation of the Law. The L1B are not supposed to be based/hosted in client location unless specifically stated in the approved petition. Defiantly not supposed to do in case of blanket L1B.

This does not need to be paid to HDFC. You can pay cash, in my case I paid cash for this.
Whats the fee of INR 155 for? Nothing of that sort was mentioned to me by the consular officer. He just asked to submit the passport. But if you do have to submit, should I get it in form of a receipt from HDFC as I did for the visa appointment or just cash?

I am not aware of anything that says that you need to bring this up initially in your job search. I personally wouldn't put it in my CV.
Apply for a job, as you would if you had a green card (keeping within the AC21 parameters.) If the question of visa sponsorship comes up then you can say you do not need it. I am not sure why people bring this up with their prospective employers. If you have employment authorisation, you have it, it is not employer specific, it is not site specific, it is quite broad in its scope. The employer
has to complete the I-9 like for anyone else. Any issues would be with the USCIS at the time of adjudication and that would be if AC21 rules are broken.
I think that sometimes we project our own fears onto employers and make issues when none exist. I've seen the same sort of doubts expressed about AP travel.
Folks need to grow more confident generally. For many their immigrant petitions 140s have been approved and their 485s have been pending for quite a while. They give you these interim benefits for a reason, so you can use them!

Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.
But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

Companies can and will have internal documentation standards regarding employibility.
In fact lately, judges have even upheld firings of smokers from certain companies.
IF there is a pattern of discrimination based on age, sex, national origin etc etc. THEN you can sue.. but NOT just because you don't like the policy of the employers..

Maybe FOIA request by IV was one of the main causes for this data to be posted on the USCIS website. USCIS thought that since the cat is out of the bag anyways, why not make the data public as part of the redesign effort of the USCIS website.
If the data provided to IV on the Donor forum matches with that of the USCIS site, there might be some other details in the IV report that can give us a better picture.

Got RFE (sept 10, 2010). was working on RFE (medical report needed)..
Today I spent around $300 to start medical exam report. I've to still to do lab work and may need x-ray. I was working with my swollen arm and got this message..
Your Case Status: Card/ Document Production On September 22, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

You stand is understandable, but I still will urge you to join me. It is of course not illegal but unfair towards the people already in EB2 line. If there were no limits on visas, it will not have been an issue to begin with. Think about the depth of the issue.

Mostly it is because I don't think MOST of the folks who use PD porting are doing it illegally or even cutting through the line undeservedly. If I am not wrong, these folks will have put in the time (work exp wise and/or added higher education) and should rightfully get the position certified as EB2.
Now granted that there are always a small minority people who genuinely are not deserving. First, can you define in your view what kind of PD porting is unethical?
Additionally, can you back up your claims by providing any kind of stats of such cases per year and how much impact it really causes to the GC wait time of those already waiting in queue for EB2? Are they that significant for you and Rolling Stone to feel so wronged?
In conclusion, unlike the unjust labor substitution process, your case is not convincing because I don't think most people availing PD porting are doing anything wrong legally and ethically. I would love to see stats and examples though.

Let us talk about the "skills" introduced by H1/L1/offshore companies
a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

My classmates are CS professors at some top Univs. Soem of them are chairpersons at top conferences. Are you going to point to them and say Indians math skills are not good?

My wife had her first time H1 visa appmt at chennai on Jan 22, 08...she got her passport back the next day at the VFS counter.
I had my visa renewal appointment at Toronto on Jan 23, 08, but I had to wait for 4 business days after interview to get my passport back. I got it only on Jan 29th.

There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
