The case is not in his wife's hand anymore. As soon as the police came on site the case is People Vs Terriblething. Only thing is that the DA may be a little weary of pushing too much if his only eye witness (the Wife) does not want to push the matter.

It cannot be people vs terriblething. It could be state/federal agency v. terriblething. I agree that credibility of the complaint can be easily attacked if wife gives contradicting statement.

This is not new, I was advised the same by my attorneys. I have heard "internet rumors" of people successfully filing EB-2 for job descriptions such as senior software engineer and senior systems analyst, which are normally classified as job zone 4. However, I was advised by two different law firms that this is not possible. According to both attorneys I consulted, you must get a job zone 5 classification to file EB-2. Note that "information technology manager" is job zone 5, so if you're in a senior position and supervising people (e.g., a manager or even a team lead), you may be able to obtain this classification.

As soon as we take a single skilled immigrant from a developing nation, around 17 different families may be put in line to follow because of our reckless Chain Migration policies.
Our immigration policies literally "take a village" every time a new Anchor Immigrant is admitted to this country.
Fortunately, our immigration policies do have a few boundaries and delays that keep the whole village from entering our U.S. communities immediately. But every one of the members of those 17 families begins to consider future immigration to the U.S. as an entitlement. And because of that, millions don't wait for their turn, instead settling in the U.S. illegally to wait for the greencard that they believe is rightfully theirs.
THE 'ANCHOR IMMIGRANT'
Our U.S. population is exploding -- consigning more and more of us to heavily congested, heavily regulated lives -- because of high immigration numbers, which have snowballed because Congress insists on continuing Chain Migration.
Because of Chain Migration, every immigrant we allow into the country because he/she brings a special skill, education or experience becomes an Anchor Immigrant.
That is, if officials determine that an employer can't find an American to fill a job and allow the importation of a foreign worker, that worker becomes an anchor in the U.S. for vast numbers of other people from his/her home country.
One problem for the United States is that only the Anchor Immigrant is supposed to be picked on the basis of serving the national interest.
All the other immigrants attached to that Anchor through Chain Migration get to come without any regard whatsoever to their education, skill or humanitarian need.
ONE ANCHOR CONNECTS TO 17 FAMILIES
My "17-Family Chain-Migration Village" example is not close to the worst possible scenario but it is a nightmare that is not uncommon.
Here's the scenario:
Consider a typical Anchor Immigrant who comes from a developing nation and has three adult siblings. All of them come from one family. As soon as the Anchor Immigrant is accepted, all those siblings know that the Anchor Immigrant can put them in line for immigration once he/she becomes a U.S. citizen. Mentally, that one whole family is now in line to come to America.
But there are many more families who mentally get in line, too. The Anchor's spouse, plus each of those three siblings' spouses will be eligible. That makes five families now in line (the original plus the families of the four spouses).
In every one of those families are their own siblings, minor children, parents, etc. This is getting to be quite a crowd of people who suddenly see their future as possibly being in the U.S. That makes five families involved now (the original and the four spouses' families).

That potentially adds up to 17 families that immediately can know that they are in a chain that eventually can have a chance to immigrate to America. And all of that happens the minute our government decides to give a permanent work permit to a single foreign worker.
An Anchor Immigrant immediately creates chains of expectation into possibly 17 different families.
You can imagine how a village or urban neighborhood can quickly have most of its residents seeing that their future is in the United States. Not only does this build huge pressures for more migration and more population growth in the U.S. but it saps whole villages and neighborhoods of the will for self-improvement.
Why will people pour themselves into bettering their own communities when they believe their future lies living in America? And, of course, the chain migration does not end with those 17 families. Our rules are set up so that every Chain Immigrant also becomes an Anchor Immigrant, making it possible for every relative to get in line to come to the U.S.
The only solution is to end the Chain Migration categories entirely. (See our pages on the legislative solutions.) That means limiting each Anchor Immigrant to bringing a spouse and minor children. No adult children, siblings or parents.
The Anchor Immigrant can easily visit his/her relatives annually (or more often) and can be in constant communication by phone, internet and postal mail. Chain categories must be ended if we are to avoid the nightmare of 439 million U.S. population in 2050 as projected by the Census Bureau.

Sen. Menendez of New Jersey is blocking the re-authorization of E-Verify (to keep illegal aliens out of jobs) until Congress agrees to add 550,000 additional Anchor Immigrants next year.
At the moment, the leadership of both Senate and House are seriously considering trying to pass the 550,000 increase in Anchor Immigrants.
Powerful media like the Los Angeles Times and New York Times are lobbying hard for more Anchor Immigrants.
Unless the American people themselves become fully aware of the dangers of Chain Migration and the concept of the "17-Family Chain-Migration Village," the Big Business and Big Media lobbyists are likely to multiply the chain migration nightmare many times again.
Make sure you have gone to your NumbersUSA Action Buffet and sent all your free faxes to push your Members of Congress to stop Sen. Menendez and to eliminate Chain Migration.

This is the third time an Indian American has won the competition in a row.
BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.
All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.
How do you support your statement? and how many Bee contestants have you met/talked to?
in studies you can not force someone, you can only help them stay focused, having lived in NJ for 6-7 years i have met dozens of india american teenagers, very rarely have i heard them going to so caled "teenage clubs" where they do all the kinds of nasty stuff. teaching kids how to stay away from things that would hurt them in the long run, and spending enough time with them is what most immigrant(not just indians) parents do.
15 years from now when you see more than 50% neurosurgens are of indian origin, please stand at times square with a banner "these neurosurgens are not brilliant but they were forced by their parents" :p

The road is long and hard. I am sure all our hard work is going to pay off. This is not the time to get impatient or frustrated. Remember we are all in this together. Let's be patient and wait for things to unfold.

The one important thing people conveniently forget about CIR : the illegal aliens will NOT be able to apply immediately for a green card. Thats pure baloney being spread by vested interests like our self-appointed "Ombudman".
If you care to read the fine print, the original CIR has clearly mandated that all legal applications pending at the time of passage must be cleared before ANY illegal alien can apply for a green card. So assume CIR gets passed into law on 30 jan 2007 (OK that was overly optimistic :) ). All family-based and employment-based petitions with a PD prior to 30 Jan 2007 must be cleared before any illegal alien is eligible to apply. Anybody who has glanced at the visa bulletin might know that retrogression in FB goes back to 1980 in some categories. So, it may well be close to 25 years before any of today's illegal aliens can apply for a visa number. I would think that is sufficient time for congress to shore up USCIS to reach the strength required to process that many applications. This is the INTENT of the original CIR, what changes in the new (posibly more liberal ? ) version and how strictly USCIS will implement it is a different ball game altogether.
Realistically, it is highly unlikely that a democratic congress or the president will entertain standalone legislation like SKIL given the chances of CIR being revived. So chances are any relief we can get has to come through a comprehensive measure like CIR.
Assuming this congress and senate would favor CIR...

This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.
I agree with you. Next week we will see the bulletin and then some people will be elated if their predictions come right and some will be disapointed. Again in 20 days we will start a new thread for Oct bulletin and FY 2010. I guess it is just that we are keeping alive our hopes.

I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
That company is MSU software based in Iowa ( just in case if anyone knows about it ) .
I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.
I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .
I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .
I have sent the email to info@immigrationvoice.com just now.
Thanks folks for all your support. it really helps that some is there to here the concerns and provide suggestions .

My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

Now that the initial send flowers campaign was a success, can we think of a second round of flower campaign? This time to Ms. Rice.
If this is a good idea, let us collect money (from as low as $1 to as much as you want to contribute) and send flowers from a common point? May be we all can pay IV specifically for this purpose. IV can then order flowers from a vendor and negotiate a better price.
The advantage of this approach is that even people who would not want to spend the $30 bucks can contribute what ever they are comfortable with. Even $1 would help. I am confident that we can raise atleast $10,000 for this effort. $10,000 would translate to 10,000/30 = 350 flowers. We could target July 25th (15 days from now) as the last day of contribution.

I agree. I personally wud never do that. i.e Why the hell should we clean the streets of an alien bcos thier system is broken? Thats my personal opion. Didnt mean tio hurt anybody.
Like somebody pointed out, the move shud come from employers. Again taking leave etc for a day(bandh) is the not the way. The govt shud be genuinely convinced of the cost/benefits of ramping up or increasing visa numbers inorder to make any move. We should do stuff in that direction as opposed to expressing frustration.
I am sure most of us here (especially from India) were pampered and did not even clean their own study desks or rooms of their house when they were young, now they are ready to sweep the roads of a foreign country to get the foreign government attention to get their gc :)

Anyone reading this thread who was able to file the 485 in the July/Aug window. These questions are particularly directed at you. I know some of them are rhetorical, but I want to provoke a little thought.
1) Do you consider this(having filed 485) to be a better situation for yourself and your family?
2) Do you consider that IV advocacy and lobbying, flower power, media attention etc played a large role in this reversal?
3) If instead of what happened, they had instituted a policy where you could file 485 while retrogressed if you pay a $1000 extra filing fee per petition. Would you not have done it?
4) If you answered yes to all the above questions, Can you find it in you to do the honorable thing and contribute something, to say thank you.
We had atleast 320K 485 filings, if just 10% of these people contributed something, anything at all, money would not be an issue. Why is this not happening? There should simply have been a better response to the request for donations. Forget about the other guy, you just do your part, even if you did not do it before you benefited, do it after you did. Do it because it is right. Do it because, the more you do the better your chance to get further. Remember nothing invested, nothing gained.

I doubt it. When a person uses his AP, his status changes to PAROLE, hence he can't have dependents on H4 status.
