If you want OCI, there are a few hoops to jump through -
1. Apply for an Indian passport first.
2. Once the Indian passport is issued, apply for the US passport.
3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.
4. Now you can apply for OCI on the grounds that your son once held an Indian passport.

Did you get copy of approval notice for I-140? I mean I-797 approval notice for I-140.
I got only I-140 application copy with labor and not the approval notice with the help of FOIA.

I went through the Federal Firearm Law and here is what I found:
(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements. Same experience. The checks were cashed super quick and the receipt notices were also mailed out. Now we wait in anxiety to see whether we receive the 1 year or the 2 year EADs.
Based on my research, any processing that they do after June 30th, in most cases, they will issue 2 year EADs.
Just wait for 2 months.
From USCIS perspective, EAD is probably the most simplest thing that they do. Dont worry much about it. It will happen. You will get a 2 year EAD.

I concur with you 100%, they are just trying to instigate IV and other members to make a wrong move. People in U.S forget that everyone is an immigrant and this country is a land of immigrants. This really informs us about the people, their education system and finally the implementation of the knowledge gained from that education.
Modern way of thinking is not about ipods, laptops and Hd dvd players, but it about thinking from a broader perspective and changing your thinking over time.

I opted for the CP option as well. My I-140 was approved in Oct 06 and thats when my attorney received the package for Consular processing from NVC.
Although my PD is not current yet, my lawyer asked me to pay the fees so that they can send the packet back to NVC. I am not sure what to do as my PD is not current yet.
How the hell did you get packet 3 from the NVC before you PD was current.??

I want to take this opportunity to introduce you to this new effort taken up by a group of people badly hit by the immigration delays or we can say immigration black out in U.S..

1) Find solution to employment based greed card retrogression

A lot of people seem to be saying this. It seems e-filing AP usually triggers a new FP notice. If this true then it will certainly delay things. We would be better off filing AP by paper.

I filed EAD by paper to TCS and got the "Card Production Ordered" email yesterday (in 14 days) for myself and my wife. My friends who efiled just received finger printing appointment notification and no receipts. Is there same benefit with AP? Please calrify.

Ask them to get an International ATM card with Citibank or ICICI and just withdraw the money here in dollars after they send it to you. It might be around 3% to 5% for transaction charges. Otherwise just have it wired - definitely a fixed cost option. 30% is robbery - I heard even western union isn't that costly - check out their website

In which case, USCIS can revoke an approved I-140 without any notice on the basis of fraud, which would automatically lead to your I-485 denial. I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. Send an email to info at immigrationvoice dot com so IV can get in touch with you to help.

There is something which is personal...buying a house is one such...opinion poll shouldn't decide that....GC or not if you feel like buy one...
We went thru the same decision 3 years back but not buying a house was one of the best decisions....the best way is to ask people who are selling houses....in the northeast it is a hell to sell houses.
My suggestion if you are a medico or a lawyer go ahead....but being attached to the tech sector is no safety net for buying a house....I have had friends with 300K take home file for bankruptcy in this economy after both members loose very lucrative jobs....just a statistic...by 2010 more than 50% households in the USA will owe more for mortgage than their houses net worth.....
Again it is an individualistic decision....go ahead if you feel confident...two things you must make sure you are in the house for at least 3 years....tax savings are no security...house tax and work on the house do add costs up....
+ House in USA is no longer an equity proposition but a liability...

I would not worry much about whether we receive our package back or not. Because If USCIS is "rejecting" then how would you/your lawyer know that it has "rejected" it unless it sends the crap back. So legally USCIS HAS to return /mail back to you otherwise it will face another lawsuite. The real question is How it will reject it? Would it open a package and check for insufficient/improper documents and put a note about it and then reject it OR just put a note of rejection on closed envelope and returned back without opening it? In second case we are absolutely fine as far as second time filing is concerned but guys in first scenario if you really send insufficient documents/improper documents then your case may be screwed permanently for second time filing. Actually people MUST ask about this to their lawyers before jumping into the bandwagon. I have asked and waiting for my lawyer's response.

Folks I wish your suggestions would be helpful, but I have taken 3 infopass appointments, and to my badluck, everytime I visit I meet the same old-fat-lady who now happens to remember me, and says, "Didnt I tell you last time that blah blah blah ", believe me, she was not willing to even accept request to send interim ead , she gave some reason that NSC outsourced callcenter work to contractors who dont know what they are saying and send us to local office to request interim EAD. She says my FP for ead was done only in Nov(my 2nd infopass resulted in 2nd FP) so it will take 4-6 weeks after that to get EAD. Anyways I will take your advice for a 4th infopass next week.
Print that USCIS memo (see page 1) and insist that they follow procedures outlined in the memo. They required to provide you a written notice that they followed the procedures. Do not leave until they give it to you in writing. If they refuse, ask for their names and write them down. Ask them for a written notice that they refuse to follow the procedures from the memo. Try to be polite, even though it is hard during infopass, I know :) I know how frustratiing it can be when you go for infopass appointments, but be persistent and talk to the supervisor.

The back-ground checks are sub-sets of "pre-approval process". I don't know if the word "pre-approval process" is official terminology used by USCIS. What I am usually reading is "adjudication process".
